Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and SMARTAURA PRIVATE LIMITED ("SMARTAURA," "we," "us," or "our") regarding your use of our IoT products, smart home devices, mobile applications, and related services.

Description of Services

SMARTAURA provides:

• WLC, a smart water level kit made up of a pump controller and a solar-powered tank sensor
• The SMARTAURA app for Android and iOS, to monitor and control your water system
• Cloud services that connect your devices to the app
• Installation, customer support and technical assistance

Eligibility and Account Registration

Eligibility

You must be at least 18 years old to use our services. By using our services, you represent that you meet this age requirement.

Account Registration

To use certain features of our products, you may need to create an account. You agree to:

• Provide accurate and complete information
• Keep your account information updated
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use

Product Purchase and Delivery

Orders and Payment

• You can order through the call-back request on our website, or by contacting us by phone, WhatsApp or email
• All orders are subject to acceptance and product availability
• Prices are subject to change without notice
• Payment must be made in full before product delivery
• We accept various payment methods as indicated on our website

Delivery

• Delivery times are estimates and may vary
• Risk of loss transfers to you upon delivery
• You are responsible for providing accurate delivery information

Warranty, Installation and Returns

2-year warranty

The WLC controller and tank sensor come with a 2-year warranty from the date of purchase against defects in materials and workmanship. If a covered fault appears, we will repair or replace the product free of charge.

The warranty does not cover:

• Physical damage, such as drops, cracks or a broken antenna
• Water damage to the tank sensor from putting it under water
• Water damage to the controller from direct rain or splashes
• Opening the device, or repairs by anyone other than SMARTAURA

Installation

Installation by a SMARTAURA installer is included in the price. Our installer aims to finish within 45 minutes. If the installation takes longer, we will refund ₹500.

• The 45 minutes start when the installer begins work
• The promise applies only to installation by a SMARTAURA installer
• It does not apply to delays caused at your site, such as no power supply, weak or no Wi-Fi, a pump or tank that can't be reached safely, or wiring that needs repair first

Returns and refunds

• Products may be returned within 7 days of installation, in their original condition
• Refunds will be processed within 7-14 business days
• After 7 days, faults are handled under the 2-year warranty

Use of Products and Services

Permitted Use

You may use our products and services for personal, non-commercial purposes in accordance with the provided instructions and documentation.

Prohibited Activities

You agree not to:

• Reverse engineer, disassemble, or modify our products
• Use products in ways that could cause harm or damage
• Interfere with the normal operation of our services
• Attempt to gain unauthorized access to our systems
• Use products for illegal or unauthorized purposes

Data and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

• Device usage data may be collected for product improvement
• You can control data sharing through device settings
• We implement security measures to protect your data

Intellectual Property

All intellectual property rights in our products, services, and content belong to SMARTAURA or our licensors. This includes:

• Product designs and technology
• Software and mobile applications
• Trademarks and brand names
• Documentation and user manuals

Limitation of Liability

Important: Please read this section carefully as it limits our liability to you.

To the maximum extent permitted by law:

• Our total liability shall not exceed the amount you paid for the product
• We are not liable for indirect, incidental, or consequential damages
• We do not guarantee uninterrupted or error-free service
• You use our products at your own risk

Indemnification

You agree to indemnify and hold harmless SMARTAURA from any claims, damages, or expenses arising from:

• Your use of our products or services
• Your violation of these Terms
• Your violation of any third-party rights
• Any misuse of our products

Service Availability

We strive to maintain service availability but cannot guarantee:

• Continuous, uninterrupted access to our services
• Compatibility with all network configurations
• Error-free operation of all features

We may temporarily suspend services for maintenance or updates with reasonable notice when possible.

Termination

These Terms remain in effect until terminated. We may terminate or suspend your access to our services:

• For violation of these Terms
• For fraudulent or illegal activity
• With notice for business reasons

Upon termination, your right to use our services ceases immediately.

Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes shall be resolved through:

• First, good faith negotiations between the parties
• If necessary, arbitration under Indian Arbitration and Conciliation Act
• Courts in the jurisdiction where SMARTAURA is located

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms on our website
• Sending email notifications to registered users
• Providing in-app notifications

Continued use of our services after changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
